It’s not the first thing that pops into your head when you think about Texas, is it? CBD Oil I mean, or even cannabis.

For most people Texas is about barbecuing giant half cows on hot plates, chewing tobacco, open-carrying handguns, and the Houston Rockets. So, in a place as stubborn as an old cowboy, why make CBD oil legal Texas?

The Houston Chronicle reports that:

Hemp and hemp-derived products that have become increasingly easy to find in Texas are now legal, too, after Gov. Greg Abbott signed a bill legalizing its production this week.

Not only does the bill set in motion a process for creating state regulations around the monitoring and production of the plant, it also clarifies that hemp-based products such as CBD oil are legal as long as they contain no more than 0.3 percent THC, the psychoactive ingredient that gives users a high.

This limit of 0.3% THC is in line with federal policy that differentiates hemp from cannabis-based not on form, but the THC level. Anything above 0.3% THC will still be classed in the state of Texas as Cannabis and hence illegal. But anything below 0.3% which includes most standard CBD oils will be classed as Hemp and thus legal. This is a huge win for the people of Texas.

Here’s what you need to know about the bill:

1) Regulations are still months away, so experts are stressing “buyer beware.”

The state’s Department of Agriculture has 90 days to submit for approval a plan to the secretary of the U.S Department of Agriculture. The regulations will likely include provisions creating a hemp grower’s license program, allowing random inspections and testing of crops by the departments of agriculture and public safety and setting requirements for packaging and labeling. Experts have said that means Texans should be careful about checking the source of any products they buy until then.

Tests of unregulated CBD oil have found they don’t always contain what those selling them claim. An NBC station in Miami tested products and found 20 out of 35 contained less than half of the amount of CBD advertised on the label. Last month, Houston police reported testing CBD products and finding illegal synthetic cannabinoids.

Of course, this is correct. We hear it again and again that the problem with the CBD industry right now is unregulated products and so it makes sense for Texans wishing to source CBD oil to only buy from a reputable company.

2) The newly legal hemp-derived CBD oil is not much different from what’s available under the state’s medical marijuana program.

As the Chronicle reported last month, the 0.3 percent CBD oil hardly differs from the marijuana-derived CBD oil offered to patients in the state’s Compassionate Use program, which contains 0.5 percent THC. The medical marijuana program in Texas, one of the most restrictive in the nation, has previously only been open to patients with intractable epilepsy. A bill passed this session would expand it to include more diseases, such as autism and terminal cancer. That’s left some marijuana advocates arguing that restrictions on the medical program should be lifted.

The Medical Marijuana Scheme in Texas seems similar to the Special Access Scheme in Australia and other ‘schemes’ around the world.

Essentially, ‘Medical Marijuana Scheme’ is really in name only since restrictions are so ridiculously tight and the products offered under the scheme only loosely resemble cannabis anyway.

At least now, people can get access to quality CBD oil without all of the rolling around in haystacks. For many, the unrestricted levels of CBD oil might be enough to help with their conditions.

3) Marijuana is still illegal.

Marijuana and hemp are two versions of the same plant, but hemp generally contains less THC. Sorry, pot smokers, marijuana is still off limits. This bill only legalizes hemp.

That’s right folks. Anything containing more than 0.3% THC is still classed as cannabis and is thus illegal in the state of Texas. Of course, there is a strong push for full legalization at the federal level but since that could still be some way off, anyone seeking a big dose of THC might be better flying north for the winter.

But what is incredibly interesting is that under this new law which states that anything under 0.3% is hemp rather than cannabis has overlooked a small factor. According to this video, the instrumentation and research required to develop a method of testing levels of THC in plants have yet to be developed. Also, it may run up costs into the millions. This has thrown a bit of a spanner into the legal system now since someone getting busted with a few lbs of weed in Texas can now claim that it is hemp and there is currently no way to disprove that. So, certainly, things are getting more interesting in the Lone Star State.

Hello Andy, the last place whee I thought cbd would be legalized is Texas and I’m actually surprised the bill was passed before the instigation of regulations and sanctions but then, things always surprises us. Maybe the health benefits was strictly considered. I like the fact that a clear difference was stated that if was not marijuana that was legalized and as such, we know at least, cbd would not be abuses by them. Thanks for this article
