It’s an easy enough question to ask. One would expect an easy enough answer. But words are addictive. So, as with many simple things, we have complicated the whole darn thing to near scientific levels. Having said that, I understand what people are asking when they ask the question: Is CBD oil marijuana?

What people are asking is in three parts:
1.) If I take CBD oil, can I get in trouble with the police?
2.) Will I get high if I take CBD oil?
3.) If I take CBD oil, does that classify me as a pothead?

is cbd oil marijuana crimeThe answer to this depends on where you live. In some countries such as the United States, you can have CBD oil and not get in trouble as long as it is below 0.3% THC. If it is above 0.3% THC, then it depends on which state of America you live in. Oil with THC above 0 .3% falls under the classification of Marijuana, but, we’ll get to that.
If you live in the European Union it’s different. You can have CBD oil as long as it is less than 0.2% THC and made from industrial hemp approved by the European Union. Getting complex right?

What is Industrial Hemp?

Industrial Hemp is cannabis that is grown for industrial purposes. It typically has very low levels of THC so you wouldn’t want to smoke it. It is very good for making CBD products, rope, textiles. Hemp seeds are a superfood.


Will I get high if I take CBD oil?

Standard CBD oil for therapeutic use generally contains less than 0.3% THC. This will not get you high at all. CBD oil is a muscle relaxant and an anti-inflammatory, nothing more. At this level, the CBD feels no different from taking aspirin.
Then other types of CBD oil have larger doses of THC. These are for stronger pain and other conditions. If you buy from a reputable brand and read the THC content there is no chance of you getting stoned by accident.
These days’ people like to refer to cannabis (marijuana) and hemp as two different things. But, they are the same plant. Hemp is a low-level type of cannabis. From a political perspective (In America), hemp contains less than 0.3% THC Cannabis contains more than 0.3% THC.

How much is 0.3% THC?

Consider that smoke-able strains of Marijuana start around 5% for gentle outdoors strains. They get over 20% for some of the stronger strains. This being the case, you won’t even notice 0.3%.
There are also differences between Cannabis Sativa, Cannabis Indica and the lesser-known Cannabis Ruderalis. Sativa is by nature high in THC and will get you stoned. Indica and Ruderalis are much lower in THC and higher in CBD so they give you more of the muscle relaxant effect.
There are many varieties of CBD oil. To get the therapeutic effects without the high, the key is to get a good amount of CBD with very low THC. It is best to buy high quality, pure, full-spectrum oil and check the THC levels. For the therapeutic variety, keep it under 0.3%.

From the ages of 22-26, I would consider myself a pothead. But, it wasn’t the pot that made me a pothead. It was my actions that went along with it. I didn’t do anything. I lied on a couch, watched TV, and ate a lot of food. Sometimes I would read and get into the garden. I could do nothing, not say much and never clean up that made me a true pothead.
But, I have friends that smoke pot every day. They have full-time jobs. Some of them have families. Some of them go to the gym four or five days a week. The stigma of the pothead is changing in our world as cannabis gets legalized. People are becoming educated about important differences between strains. 
Anyway, enough about actual pot. Regular CBD oil has no ‘stoned’ effect whatsoever. So does it make you a pothead? It’s probably no different to wearing a jumper made of hemp so you might as well embrace it.
Politically speaking, CBD oil is Marijuana (in the United States) if it contains more than 0.3% THC.
If it contains less, it is classed as hemp.

So to answer the question, if it’s below 0.3%, CBD oil is not Marijuana. If it’s above 0.3% then it is. At least that’s what the government says and we know they never lie to us.     In terms of cannabis, I think the grass these days is very strong. I’m sure in California though, you could could get access to some good old fashioned, outdoor grown bush weed. Then, if you were so inclined, you could experience something quite pleasant.

  3. I found this article cleared up a lot of the nuances about the relationship between CBD Oil and Marijuana. It all seems to come down to the legal definition instead of the scientific one. CBD to me is not Marijuana even of it has such low quantities of THC. If it doesn’t make my high then it is not Marijuana. 

    However, the Law is the Law. This article definitely helps one understand what is and is not legal and use that as a guide when using CBD for medical reasons. 

    Since I live in California there is ore latitude here as smoking marijuana for recreational reasons is legal now. Perhaps sometime in the near future politicians will get wiser and legalize the whole thing. If tobacco and alcohol are legal, why not Marijuana? Tobacco and Alcohol can do more damage than Marijuana so it doesn’t make sense. 

    It is interesting that the THC component is being used in alcoholic drinks. I have a very low tolerance to Marijuana. The few times I have used it I felt so bad and freaked out. I often wonder how I would react to beer say infused with THC?

  5. Thanks for the info, Andy. Trust me when I say, I’ve had a hell of a time explaining to my parents that they can take CBD oil and not be considered a “pothead”, which like you said, has more to do with lifestyle than consuming parts of a particular plant. 

    Then, one day, they come back from Costco with a bag of hemp seeds to put into their morning morning cereal, telling me that they heard this hemp stuff is great for getting in fatty acids… 

    It goes to say that the benefits of this misunderstood plant is almost incomprehensible to those who can’t look past social stigma. 

    Luckily we are getting away from these stigmas as awareness grows. Thanks to blogs like yours. I am a huge proponent of Marijuana and Hemp products. Every single one. Might be a little stoned as I’m typing right now…
